Terms & Conditions

  1. In these conditions the term ‘the Company’ means Merchant Yachting. ‘The Client’ shall mean the person or company in whose name the booking is made and accepted.
  2. The signature of the Client on the booking form implies acceptance of these Terms and Conditions by the Client names on the form and by all other persons included in the party.
  3. Once a booking has been accepted a deposit of 50% of the fee is payable in advance to secure the booking, with the remaining 50% payable 4 weeks prior to commencement of the first date of the charter. Bookings made less than 4 weeks before the starting date of the charter must be accompanied by the full charter fee.
  4. Cancellation by the Client if received more than 4 weeks prior to the commencement of the charter will result in loss of deposit only. If the Client cancels within 4 weeks of the commencement of the charter, they are not entitled to any refund and any balance of charter fees not paid remains due.
  5. A refundable deposit, the value of which will be established at booking, is due 7 days before the commencement of the first date of the charter. This deposit covers any incidental costs as well as any costs incurred for any loss or damage to property of the company caused by the Client. The deposit will be held by the Company and returned within 14 days from the end of the charter.
  6. The booking fee includes all costs of using the yacht for the period; mooring, insurance, safety equipment for the Client and a skipper. It does not include accommodation, food, beverages, alcohol or travel to and from the charter.
  7. Acceptable terms of payment of the booking fee and any other costs related to the hire of the charter are personal or company cheque (allowing 7 days for clearance), BACS, bankers draft or cash.
  8. The Company reserves the right to modify, postpone or cancel any charter at its absolute discretion particularly in event of adverse weather conditions. In such cases the Company’s liability will be limited to the return of fees and deposits already paid. It shall not be liable for any other consequential loss, damage, delay or inconvenience resulting therefrom.
  9. Compensation will not be payable if cancellation or change by the Company is brought about by war or threat of war, riots, civil commotion, strikes, disaster, terrorist activities, technical problems with transportation, closure of airports, alteration or cancellation of scheduled services, or other events outside the control of the Company.
  10. The Client is required to provide the Company, on booking the charter, a list of persons included in the party. All Clients are advised that an average standard of physical fitness is necessary and the Company must be informed on booking of any physical or medical handicaps. The Company reserves the right to refuse to accept a Client on any charter.
  11. All Clients and their guests must be able to swim a minimum of 50 metres and provide the Company with a signed declaration of this (see booking form). If they are unable to meet this requirement they will be required to wear a life jacket throughout the duration of the charter.
  12. If for any reason the charter, as a result of mechanical failure or adverse weather, is terminated away from the Company’s home berth of Saxon Wharf, Southampton, the Company will cover any costs associated with travel back to the home berth.
  13. Should a Client or guest wish to permanently leave the boat at anytime during the charter, then they will be delivered at the nearest safe port harbour in the view of the skipper. No refund of charter shall be due and transportation costs from the safe port to the home port will be borne by the charterers.
  14. Clients are required to carry out the instructions and orders of the Company’s personnel at all times while on the charter.
  15. Smoking on the Company’s craft is strictly forbidden.
  16. In all matters arising out of the Company’s Terms and Conditions of Business, the decision of the Company shall be final.
